Motor Vehicle Maintenance and Insurance Claim Risks

Insurance disputes often arise after an accident, especially where the insurer alleges that the vehicle was not properly maintained.


The issue

A driver may collide with a stationary vehicle and then submit a claim for the damage. The insurer may investigate and reject the claim if an assessor reports that the vehicle was unroadworthy, for example because the front tyres were smooth.


Why it matters

The condition of the vehicle can affect the insurer’s assessment of the claim. The policy wording, the cause of the accident and the evidence about roadworthiness all become relevant.


Practical point

Vehicle owners should keep their vehicles roadworthy and maintain proof of repairs, tyre replacement and servicing. These records may assist if a claim is disputed.
